TERMS AND CONDITIONS

*  THE CUSTOMER/SENDER IS RESPONSIBLE TO SECURE THEIR PACKAGE(S).
*  THE CUSTOMER/SENDER MUST PROVIDE CONTACT NUMBERS FOR BOTH SENDER AND CONSIGNEES.
*  THE CUSTOMER/SENDER MUST PROVIDE THE LIST OF CONTENTS AND THE DECLARED VALUE OF EACH PACKAGES.
*  THE CUSTOMER/SENDER SHOULD DECLARED ALL THE CONTENTS OF THEIR SHIPMENT INCLUDING ELECTRONICS.
*  THE CUSTOMER/SENDER IS RESPONSIBLE TO ALL DUTIES, TAX AND PENALTY CHARGES TO ALL UNDECLARED ITEMS DUE ON THE SHIPMENT AND/OR INCURRED FOR IT'S RELEASE.
*  THE CUSTOMER/SENDER ARE RESPONSIBLE FOR ALL FREIGHT CHARGES, COSTS, AND EXPENSES INCIDENTAL TO THE FINAL DELIVERY TO THE CONSIGNEE.
*  IN THE EVENT THE SHIPMENT/PACKAGE(S) IS UNDELIVERABLE, THE CUSTOMER/SENDER ARE RESPONSIBLE FOR ALL REASONABLE COST OF RETURNING THE SHIPMENT TO THE CUSTOMER/SENDER.
*  THE CUSTOMER/SENDER SHOULD KNOW THAT OUR SHIPMENT GO THROUGH MANDATORY X-RAY AND/OR MANUAL INSPECTION.

THE CUSTOMER/SENDER ACKNOWLEDGED AND AGREES TO THE FOLLOWING TERMS AND CONDITIONS:

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  DO NOT CATER AN EXACT DELIVERY DAY TO SENDER'S REQUEST DATE. NO SPECIAL DELIVERY REQUEST.
*  FORWARDERS AND SHIPPING COMPANIES IS NOT LIABLE FOR ANY DELAY IN PICK UP, TRANSPORTATION, OR DELIVERY OF ANY SHIPMENT REGARDLESS OF THE CAUSE OF SUCH DELAY.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR MISSING ITEMS.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  IS NOT LIABLE FOR THE DELAY OR LOSS OF PACKAGE DUE TO ACT OF GOD, NATURAL DISASTERS, (HURRICANE, TORNADOES, FLOOD, EARTHQUAKE, ETC.), ACTS COMMITTED BY PUBLIC ENEMIES, ACTS OR OMISSION OR PUBLIC AUTHORITIES, RIOTS, STRIKES, CIVIL DISORDERS, WARS, HAZARD ACCIDENTS AND INCIDENTS, ELECTRIC OR MAGNETIC INJURY, ERASURES, OR OTHER DAMAGES TO PHOTOGRAPHIC IMAGES AND FORMS, AND ANY OTHER UNFORESEEABLE OCCURRENCES BEYOND THE CONTROL OF THE PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER LIABILITY IS LIMITED TO A MAXIMUM OF $200 PER BOX UPON TOTAL LOSS OF PACKAGE (INCLUDING SHIPPING FEE) OR THE ACTUAL AMOUNT OF THE GOODS, WHICHEVER IS LESSER.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER RESERVE THE RIGHT, BUT IS NOT UNDER OBLIGATION, TO INSPECT SHIPMENTS INCLUDING WITHOUT LIMITATION TO OPENING THE SHIPMENT THAT THE PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  DEEMS MISREPRESENTED OR WITHHELD BY THE CUSTOMER/SENDER OR ITS AGENT.      

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER CAN EXERCISE THE RIGHT TO DENY ACCEPTANCE FOR TRANSPORT, ABANDONMENT AND/OR REFUSE AT ANY TIME THE PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  DEEMED UNACCEPTABLE. OR CUSTOMER/SENDER HAS UNDERVALUED OR IMPROPERLY DECLARED, WHETHER INTENTIONALLY OR OTHERWISE, THE GOODS FOR CUSTOMS PURPOSES, AND THE CUSTOMER/SENDER WARRANTS TO HOLD THE PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER  FREE FROM ANY CLAIMS, DAMAGES, FINES, AND OTHER EXPENSES ARISING THEREON.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER RESERVE THE RIGHT TO CONSIGN THIS SHIPMENT TO ITS CHOSEN FORWARDING COMPANY AND ITS DELIVERY AGENTS TO TRANSPORT THIS SHIPMENT FROM THE USA TO THE CONSIGNEE OR ITS DESIGNATED RECIPIENT.

*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER RESERVE THE RIGHT TO REFUSE PICK UP AND/OR DELIVERY TO THOSE WHO ARE UNREASONABLE PEOPLE.
*  PALAYOK SARISARI BALIKBAYANBOX SERVICE AND ITS FORWARDER PARTNER RESERVE THE RIGHT TO REFUSE PICK UP AND/OR DELIVERIES TO THOSE WHO LIVED IN REMOTE AREA IN SOME PARTS OF LUZON, VISAYAS, AND MINDANAO. PLEASE CHECK THE LIST OF NON DELIVERY AREA AND SPECIAL DELIVERY AREA.

CLAIMS

ALL RECIPIENTS ARE OBLIGATED TO REPORT THEIR COMPLAINT BY SENDING E-MAIL TO palayoksarisari@yahoo.com

IF SEAL IS BROKEN AND PACKAGE IS DAMAGED OR TAMPERED TAKE PICTURE OF THE PACKAGE AND MAKE NOTE OF YOUR COMPLAINT BEFORE SIGNING THE RECEIPT. PICTURE MUST SHOW THE DAMAGE AND SEND IT TO palayoksarisari@yahoo.com.

ANY COMPLAINT WILL NOT BE ENTERTAINED WITHOUT THE PICTURE FROM THE RECIPIENT.

CLAIM MUST BE IN WRITING WITHIN THIRTY (30) DAYS AFTER THE SHIPMENT WAS RECEIVED, SHOULD INCLUDE SUPPORTING PROOF OF VALID CLAIMS THROUGH RECEIPTS WITH VIDEOS OR PHOTOS OF THE ACTUAL GOODS, PROVIDED THAT ANY OF THIS PROOF WAS TAKEN WITHIN AN HOUR BEFORE THE ACTUAL PICK UP OR IF ANY REPRESENTATIVE OF THE COMPANY CAN VOUCH, THROUGH SUPPORTING DOCUMENTS AND PROOFS, FOR SUCH CLAIMS.

CLAIMS FOR LOSS OR NON-DELIVERY OF GOODS MUST BE IN WRITING, FILED WITHIN SIXTY (60) DAYS AFTER EXPECTED DELIVERY DATE.

GUIDELINES AND PROCEDURES IN THE SHIPMENT OF DONATIONS TO THE PHILIPPINES                                                              (FOREIGN SERVICE CIRCULAR NO. 61-11)

                Donated goods that may be allowed duty-free entry are food, medecines, and other relief goods; books and educational materials essential machineries/equipment; consumer goods and other articles subject to certain conditions.

Used Clothes are considered regulated/restircted items and can only be received by the Department of Social Welfare and Development (DSWD) and welfare organizations accredited by the DSWD.

REQUIREMENTS FOR THE PROCESSING OF DONATIONS WITH DUTY FREE PRIVILEGE

The documents required from the donor prior to the issuance of duty-free certification by the government agencies concerned are the following:

A) Deed of Donation, duly authenticated by the Philippine Consulate General;

B) Commercial Invoice and/or packing list/inventory of donated items; and

C) Shipping documents (bill of lading/airway bill).

PROCEDURES TO FACILITATE THE ENTRY, PROCESSING AND RELEASE OF FOREIGN DONATIONS

A)  PRIOR TO SHIPMENT

*  Prospective donors who intend to ship goods/articles/equipment must inform the Consulate General of their intention to donate. The donor will have to provide the Consulate with a complete list of items to be donated, name of consignee, complete address and the contact numbers and the contact person in the Philippines.

*  The Philippine Embassy/Consulate will refer the prospective donation to the Commission on Filipino Overseas (CFO). Upon receipt of the notice of intent to donate, the CFO will coordinate with government agencies concerned and the designated consignee to determine if the intended donation is eligible for duty-free entry and if the designated consignee is qualified to accept the donation free from duties. The CFO will inform the Philippine Embassy/Consulate General about the requirements and obligations in connection with the intended donation; and

*  The Philippine Embassy will advise the donor on feedback from Manila, including the requirements for duty-free entry. The Philippine Consulate General authenticates the Deed of Donation prior to its shipment in Manila.

B)  SHIPMENT OF DONATIONS

To allow sufficient time for the processing of the donations, the donor must send advance copies of the following documents to the designated consignee at least thirty (30) days prior to the actual shipment of the goods to the Philipines;

*  Deed of Donations, duly authenticated by the Philippine Consulate General; and

*  Commercial invoice and/or packing list/inventory of donated items.

The DONOR must ensure that the name of the consignee is identical in both Deed of Donation and the shipping documents, i.e. Bill of Lading or the Airway Bill. The donor must also determine that the shipment contains only the items in the packing list. The donor may also send advance copies of the aforementioned documents to the CFO through the Philippine Consulate General for purpose of coordination.

Upon receipt of the advance copies of required documents from the donor, the recipient will be advised to coordinate with appropriate agencies and submit required documents; and 

The recipient must monitor the arrival of the shipment by coordinationg with the shipping agency. The shipping agency will usually send an arrival notice to the consignee.

C)  PROCESSING OF THE DONATIONS

*  Upon receipt of the request of the consignee for the duty-free information, the appropriate agency (Department of Social Welfare and Development, Department of Education, Culture and Sports or the National Economic Development Administration) will recommend to the Department of Finance (DOF) that the importation be exempted from customs duties, if deemed meritorous. These agencies can also recommend denial of the request for exemption from payment of duties;

Upon endorsement by the appropriate agency for the duty-free entry of the donation, the DOF will issue a clearance and will forward this document to the Tax Exemption Division, Bureau of Customs (BOC). The consignee may obtain a duplicate copy of the DOF clearance from DOF;

The Tax Exempt Division of the BOC will endorse the release of donation and will forward this document to the Informal Entry Division (IED) of the BOC District Office concerned (i.e. South Harbor , Manila International Container Port, NAIA, etc.).

The IED checks, verifies, appraises, and examines the donated shipment:

*  The original copies of the Deed of Donation, commercial invoice and/or packing list/inventory, and the Bill of Lading or the Airway Bill must be received by the consignee on or before the arrival of the shipment in the Philippines to effect its release; and

*  After the consignee complies with all the documentation and pays the end charges (i.e. arrastre, wharfage, value added tax, etc.), the BOC will release the shipment to the consignee.

NOTE: All donations, regardless of its type, classification, follow the general procedures instituted in facilitating its entry, processing, and release, and should satisfy as well as the general requirements in availing of duty-free privileges. Depending of the type of donations and/or the identified beneficiaries, however, concerned Departments/Agencies in the Philippines, i.e. DSWD, Department of Health, Department of Finance, NEDA, and the Bureau of Food and Drugs, may prescribe additional requirements and procedures in the processing of foreign donations.
